Terms of Service

These Terms of Service (“Terms”) are an agreement between you and Evertrend LLC, a Wyoming, USA limited liability company (“Evertrend,” “we,” “us,” or “our”), governing your use of the BWallet mobile application and the bwallet.cash website (together, the “Services”). By using the Services, you agree to these Terms and to ourPrivacy Policy. If you don't agree, don't use the Services.

1. Eligibility

You must be at least 18 years old to use the Services. You represent that you are not located in, or a resident of, any country or region subject to comprehensive sanctions, and that you are not on any government sanctions or restricted-party list. You're responsible for making sure your use of the Services complies with the laws that apply to you — digital-asset regulation varies widely by jurisdiction, and it's on you to know your local rules.

2. The Services, In Brief

BWallet provides: a self-custody, multi-chain crypto wallet; an optional DID identity and account-security layer; in-app chat and calling (beta); access to third-party swap and bridging providers; and an optional promotional rewards program (BCC/BAI). Not every feature is available in every region or app version.

3. Non-Custodial Nature; Your Responsibility for Keys

4. Account Registration

Some features require an account, created via email sign-in or Google sign-in. You agree to provide accurate information and to keep your sign-in access secure. You're responsible for all activity that happens under your account and DID, including any optional security factors you enable. Tell us immediately at [email protected] if you suspect unauthorized account access.

5. DID Security Factors

You may optionally enable a DID password, TOTP authenticator, recovery code, wallet-signature factor, and/or backup email to help recover or confirm high-risk account actions. DID password sign-in is only available once you've also enabled TOTP, precisely because a DID is a public identifier and a password alone would be too easy to attack. None of these factors can recover your wallet's mnemonic or private keys — see Section 3. You're responsible for keeping them safe; we can't bypass them on your behalf without you completing our identity-recovery process.

6. Rewards Program (BCC/BAI)

• The rewards program is a promotional feature provided “as is.” We may modify, suspend, or discontinue it, or change reward amounts, thresholds, or eligibility, at any time, including for accounts already participating.
• BCC has a fixed total supply and rewards stop once it's exhausted. Reward balances are tracked in our database, not on-chain, until you withdraw them.
• We actively monitor for abuse (e.g. one person or device operating multiple accounts to farm sign-up rewards, or manipulating referral relationships). We may withhold, claw back, or deny rewards, and suspend the accounts involved, if we reasonably determine the program is being abused.
• Staking is not a bank deposit and is not insured. Staked BCC is sent to and held at an address we control, not your own wallet, for as long as it's staked. Redemption is subject to our processing, and network/gas fees may apply. This is a fundamentally different custody arrangement than the rest of the wallet described in Section 3 — don't stake more than you're comfortable temporarily not controlling directly.

7. Chat and Calls

Chat and voice/video calling are a beta feature and, as described in ourPrivacy Policy, are not currently end-to-end encrypted. Don't share sensitive personal, financial, or confidential information through chat or calls. We may access message or call content where necessary for safety, legal compliance, or support purposes, and this feature may change or be discontinued.

8. Third-Party Services and Integrations

Swap/bridging providers, WalletConnect, and any dApp or smart contract you interact with through the Services are operated by third parties we don't control. Interacting with them is entirely at your own risk — review their own terms and privacy practices, and understand that smart-contract bugs, exploits, or provider failures are outside our control and responsibility.

9. Fees

Network (“gas”) fees, swap fees, and reward-withdrawal fees may apply and are disclosed in the app at the time of the relevant transaction. Fees are subject to change.

10. Prohibited Conduct

You agree not to use the Services to:

• Violate any applicable law, including money-laundering, terrorist-financing, or sanctions regulations;
• Defraud us or any other person;
• Abuse the rewards program (multiple accounts, bots, device farming, referral manipulation, or similar conduct);
• Reverse-engineer, hack, disrupt, or gain unauthorized access to the Services or other users' accounts;
• Infringe anyone's intellectual-property or other rights; or
• Impersonate any person or entity.

11. Suspension and Termination

We may suspend or terminate your account for violating these Terms, suspected fraud or abuse, a legal requirement, or at our discretion (with notice where reasonably feasible). You may stop using the Services at any time. Because BWallet is non-custodial, suspending your account never affects your local wallet or on-chain assets — it only affects the optional account, chat, and rewards features described in these Terms.

12. Intellectual Property

The BWallet name, logo, app, and the content of this website are owned by Evertrend LLC or our licensors. We grant you a limited, revocable, non-transferable license to use the app for its intended personal purpose — nothing here grants you any other rights to our intellectual property.

13. Disclaimers

The Services are provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Nothing in the Services is investment, financial, legal, or tax advice. Digital assets are volatile and can lose some or all of their value. We don't guarantee the uptime, availability, or security of any blockchain network, smart contract, or third-party service the Services connect to.

14. Limitation of Liability

To the maximum extent permitted by law, Evertrend LLC will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of digital assets, data, or profits, arising from your use of the Services. Our total aggregate liability for any claim arising from these Terms or the Services is limited to the greater of $100 USD or the fees you paid us in the 12 months before the claim arose.

15. Indemnification

You agree to indemnify and hold Evertrend LLC harmless from any claim or demand arising out of your use of the Services, your violation of these Terms, or your violation of any law or third party's rights.

16. Governing Law; Dispute Resolution

These Terms are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-laws principles. Before filing any formal proceeding, you agree to first contact us at [email protected] so we can try to resolve the dispute informally. Any dispute we can't resolve informally will be finally settled by binding arbitration on an individual basis (no class actions), except that either party may bring an individual claim in small claims court where available.

17. Changes to These Terms

We may update these Terms from time to time. We'll update the “Last updated” date above, and for material changes we'll provide a more prominent notice. Continued use of the Services after a change takes effect means you accept the updated Terms.

18. Miscellaneous

These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Services. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision isn't a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets. Neither party is liable for delays caused by events outside its reasonable control.
